Youtube Copyright Issue (Need someone who knows DMCA & 1976 Copyright Act)?

Acknowledging that a work is copyrighted does not empower you to violate the copyright. You MUST obtain written permission from the copyright owner before publishing any copyrighted work. Obviously the publisher is not going to grant this permission in most cases since they rely on the sales of their copyrighted property for revenue.
